Lotus Workforce (“Company”, “we”, “us” or “our”) operates the LOTUS Workforce mobile application (“App” or “Platform”).

This Privacy Policy explains how we collect, use, process, store, protect and disclose information when you access or use the LOTUS Workforce App and related services.

LOTUS Workforce is a technology-enabled, commission-based platform that facilitates connections between Contractors, Labour/Workers, Service Providers and Customers/Clients for various services, including but not limited to electrical work, plumbing, carpentry, painting, AC services, home cleaning, labour services and other home-service categories.

By using the App, you acknowledge that you have read and understood this Privacy Policy.

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to information collected through:

  • The LOTUS Workforce mobile application;
  • User registration and KYC verification;
  • Service booking and work-related activities;
  • Payment and transaction activities;
  • Customer and Service Provider interactions;
  • Customer support communications; and
  • Other services or features provided through the Platform.

This Policy does not apply to third-party websites, applications or services that may be accessible through the Platform. Such third parties may have their own privacy policies.

2. USER CATEGORIES

LOTUS Workforce may be used by different categories of Users, including:

A. Workers / Labourers

Individuals who register to provide labour or other services.

B. Contractors

Individuals or businesses providing contractual or workforce-related services.

C. Service Providers

Professionals registered to provide services such as:

  • Electrician
  • Plumber
  • Carpenter
  • Painter
  • AC Service / Repair
  • Home Cleaning
  • Labour Services
  • Other home services supported by the Platform

D. Customers / Clients

Individuals, businesses or other persons requesting or engaging services through the Platform.

Different categories of Users may be required to provide different information depending on their use of the Platform.

3. INFORMATION WE COLLECT

We collect only information that is reasonably necessary to operate, secure and improve the Platform and provide the requested services.

3.1 Account and Personal Information

Depending on your use of the Platform, we may collect:

  • Full name
  • Mobile number
  • Email address
  • Profile photograph
  • Date of birth or age confirmation
  • Gender, where voluntarily provided or required for a specific service
  • Address
  • City, state and postal information
  • User type/category
  • Service category and professional information
  • Other information voluntarily provided by you

Mobile numbers may be verified through OTP or similar authentication mechanisms.

3.2 KYC and Verification Information

Workers, Labourers, Contractors and Service Providers may be required to complete KYC verification before accepting or performing work through the Platform.

Depending on the applicable verification requirements, we may collect:

  • Government-issued identity documents;
  • Aadhaar or other legally permitted identity information;
  • Photograph;
  • Address proof;
  • Professional certificates or licences;
  • Skill or qualification information;
  • Business information, where applicable;
  • Other documents reasonably required for verification.

KYC information is collected for purposes including:

  • Identity verification;
  • Fraud prevention;
  • User and platform safety;
  • Eligibility verification;
  • Compliance with applicable legal requirements; and
  • Maintaining the integrity of the Platform.

We will process KYC information in accordance with applicable law and will seek to limit access to such information to authorised personnel and service providers who reasonably require it for legitimate purposes.

Where possible and appropriate, sensitive identity information may be masked, restricted or otherwise protected from unnecessary disclosure.

4. LOCATION INFORMATION

Depending on the features you use and the permissions granted by your device, LOTUS Workforce may collect location information, including:

  • Location information required for matching Customers and Service Providers.

Location information may be used for:

  • Finding or matching nearby Service Providers;
  • Assigning or facilitating jobs;

  • Improving service availability;
  • Fraud prevention and security; and
  • Providing location-dependent Platform features.

You may be able to control location permissions through your device settings. However, disabling location access may affect the availability or functionality of certain Platform features.

5. PAYMENT AND TRANSACTION INFORMATION

Payments made through LOTUS Workforce may be processed through Razorpay or another authorised payment service provider.

Depending on the transaction, we may receive or process information such as:

  • Transaction ID;
  • Payment status;
  • Amount;
  • Date and time of transaction;
  • Refund or settlement status;
  • Commission information;
  • Limited payment-related information provided by the payment processor.

Where payment processing is handled by a third-party payment gateway, we do not ordinarily store complete debit card, credit card or banking credentials on our own servers.

Payment processors may independently process payment information according to their own terms and privacy policies.

6. TECHNICAL AND DEVICE INFORMATION

When you use the App, certain technical information may be collected automatically, including:

  • Device type;
  • Device model;
  • Operating system;
  • App version;
  • Unique device or installation identifiers;
  • IP address;
  • Network information;

8. HOW WE USE YOUR INFORMATION

8.2 KYC and Identity Verification

To verify the identity and eligibility of Workers, Contractors and Service Providers.

8.3 Service Matching

To connect Customers with suitable Workers, Contractors or Service Providers.

8.4 Job and Workforce Coordination

To facilitate work requests, bookings, service locations and communication.

8.5 Payments and Commission

To process payments, settlements, refunds where applicable and Platform commissions.

8.6 Customer Support

To respond to questions, complaints, disputes and support requests.

8.7 Security and Fraud Prevention

To detect, investigate and prevent fraud, misuse, unauthorised access and other security threats.

8.8 Platform Improvement

To analyse Platform usage and improve features, functionality and user experience.

8.9 Communications

To send:

  • OTPs;
  • Transaction notifications;
  • Booking updates;
  • Job-related notifications;
  • Account and security alerts;
  • Important policy updates; and
  • Other service-related communications.

8.10 Legal and Regulatory Compliance

To comply with applicable laws, court orders, governmental requests and lawful regulatory requirements.

9. LEGAL BASIS / PERMITTED PROCESSING

We process personal information where permitted or required under applicable law, including where:

  • You provide consent;
  • Processing is necessary to provide a service requested by you;
  • Processing is necessary to perform or administer an arrangement with you;
  • Processing is necessary for legitimate operational, security or fraud-prevention purposes;

Where consent is required, we will seek consent through appropriate mechanisms.

Certain information may be made available to another User where necessary to facilitate a Service.

  • Other information necessary to complete the Service.

We aim to limit the information shared to what is reasonably necessary.

10.2 Service Providers and Technology Partners

We may share information with trusted third-party service providers that assist us with:

  • Cloud hosting;
  • Authentication;
  • Database services;
  • Push notifications;
  • Maps and navigation;
  • Payment processing;
  • KYC/identity verification;

  • Customer support;

11. THIRD-PARTY SERVICES

LOTUS Workforce may use third-party technology and service providers, including:

Razorpay

Used for payment processing and related transaction services.

Google Maps / Google Maps Platform

Used for location, mapping, distance and navigation-related functionality.

Firebase / Google Services

May be used for authentication, notifications, application infrastructure, analytics, crash reporting or related services depending on the App configuration.

Third-party providers may collect or process information according to their own privacy policies and terms.

Users should review the relevant third-party privacy policies where appropriate.

12. DATA SECURITY

We take reasonable technical, administrative and organisational measures designed to protect personal information against:

  • Unauthorised access;
  • Unauthorised disclosure;
  • Loss;
  • Misuse;
  • Alteration;
  • Destruction; and
  • Other reasonably foreseeable security risks.

Security measures may include access controls, authentication mechanisms, restricted access to KYC information, encryption or secure transmission technologies where appropriate, monitoring and other security practices.

However, no electronic transmission, storage system or Internet-based service can be guaranteed to be completely secure.

Accordingly, while we take reasonable precautions, we cannot guarantee absolute security of information.

13. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including:

  • Providing and maintaining Platform services;
  • Maintaining transaction and business records;
  • Completing KYC and verification requirements;
  • Resolving disputes;

14. ACCOUNT DELETION

You may request deletion of your LOTUS Workforce account by contacting us using the contact details provided below.

Upon receiving a valid deletion request, we may:

  • Disable or delete your account;
  • Remove or anonymise information that is no longer required; and
  • Retain information that we are legally required or otherwise permitted to retain.

Account deletion may affect your ability to access previous bookings, transaction records, service history or other Platform features.

Deletion of an account does not necessarily result in immediate deletion of every record where retention is legally required.

15. USER RIGHTS AND CHOICES

Subject to applicable law, Users may have rights relating to their personal information, including the ability to:

  • Request access to certain personal information;
  • Request correction of inaccurate information;
  • Request deletion where legally permitted;
  • Withdraw consent where processing is based on consent;
  • Request information regarding certain processing activities; and
  • Raise a privacy-related complaint or grievance.

16. COMMUNICATIONS

Because certain communications are necessary to operate the Platform, Users may receive service-related communications such as:

  • OTPs;
  • Booking confirmations;
  • Job notifications;

  • Account alerts;
  • Security notifications; and
  • Important changes to the Platform or policies.

These essential communications may continue even if you opt out of optional promotional communications.

Where applicable, you may manage promotional communication preferences through the App or by contacting us.

17. COOKIES AND SIMILAR TECHNOLOGIES

The App and related services may use cookies, SDKs, local storage, device identifiers, pixels or similar technologies where applicable.

These technologies may be used for purposes such as:

  • Authentication;
  • Security;
  • Session management;
  • Analytics;
  • Performance monitoring;
  • Remembering preferences; and
  • Improving Platform functionality.

The availability and control of these technologies may depend on the device, operating system and services used.

18. CHILDREN'S PRIVACY

LOTUS Workforce is intended for individuals 18 years of age or older.

We do not knowingly intend to collect personal information from individuals under 18 through the Platform.

If we become aware that information has been collected from a person who is not eligible to use the Platform, we may take reasonable steps to delete or restrict such information, subject to applicable law.

19. USER-GENERATED CONTENT

Users may upload or provide:

  • Profile photographs;
  • Service descriptions;
  • Certificates;
  • Reviews;
  • Ratings;
  • Work-related photographs;
  • Other information necessary to use Platform features.

Users are responsible for ensuring that they have the right to provide such content and that it does not violate applicable law or another person's rights.

We may remove content that violates our Terms & Conditions, applicable law or Platform policies.

20. REVIEWS, RATINGS AND FEEDBACK

If you submit a rating, review, complaint or feedback, we may use and retain it for:

  • Improving the Platform;
  • Monitoring service quality;
  • Resolving disputes;
  • Detecting misuse; and
  • Maintaining Platform records.

Reviews and ratings may be visible to other Users where the relevant Platform feature permits such visibility.

Users should not include unnecessary personal or sensitive information in public reviews.

21. DATA RELATING TO OTHER PEOPLE

Users must not provide another person's personal information to LOTUS Workforce unless they have the necessary authority or lawful basis to do so.

If you provide information relating to another person, you are responsible for ensuring that such disclosure is lawful and appropriate.

22. INTERNATIONAL DATA PROCESSING

Some technology or service providers used by the Platform may process information on servers or infrastructure located outside India.

Where personal information is transferred or processed outside India, the Company will take steps required under applicable law and applicable contractual or organisational safeguards.

23. DATA BREACHES AND SECURITY INCIDENTS

If we become aware of a personal data breach or security incident that requires notification under applicable law, we will take appropriate steps to investigate, mitigate and notify affected parties or authorities where legally required.

Users should promptly notify us if they suspect unauthorised access to their account.

24. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links or integrations to third-party websites, applications or services.

We are not responsible for the privacy practices, content or security of third-party services that we do not control.

Users should review the privacy policies of third-party services before providing information to them.

25. BUSINESS AND SERVICE PROVIDER INFORMATION

If you register as a Worker, Labourer, Contractor or Service Provider, certain professional information may be displayed or shared with Customers to facilitate service requests.

Such information may include, depending on the Platform functionality:

  • Name;
  • Profile photograph;
  • Service category;
  • Skills or experience;
  • Service area;
  • Ratings/reviews; and
  • Relevant professional information.

We will seek to limit disclosure to information reasonably necessary for Platform operations.

26. FRAUD, SECURITY AND PLATFORM PROTECTION

We may process information to detect, investigate and prevent:

  • Fake accounts;
  • Identity fraud;
  • Payment fraud;
  • Account takeover;
  • Commission manipulation;
  • Platform abuse;
  • Misuse of KYC documents;
  • Suspicious transactions; and
  • Other unlawful or harmful activities.

Information may be shared with relevant authorities, payment providers or security partners where legally permitted or required.

27. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect:

  • Changes in the Platform;
  • Changes in technology;
  • Changes in applicable law;
  • Changes in our data practices; or
  • New services and features.

When material changes are made, we may provide notice through the App or another appropriate method.

28. GOVERNING LAW

This Privacy Policy shall be governed by the applicable laws of India.

Any dispute concerning this Privacy Policy shall be subject to the applicable jurisdiction specified in the LOTUS Workforce Terms & Conditions, subject to mandatory rights and remedies available under applicable law.
